The Mizoram Urban Areas Rent Control Act, 1974 (MUARCA)
The Mizoram Urban Areas Rent Control Act, 1974 (MUARCA)Â has a number of provisions regarding rent agreements. These provisions are designed to protect tenants from unfair rent increases and evictions.
Standard rent
The MUARCA defines “standard rent” as the rent fixed by the court on procedural calculation and not the contractual rent agreed between the parties. Once the standard/fair rent is fixed by the court, revision of the same can be made only after 5 years.
Rent agreements
The MUARCA requires that all rent agreements be in writing and signed by both the landlord and tenant. The agreement must include the following information:
- The names and addresses of the landlord and tenant
- The address of the property
- The start and end dates of the agreement
- The standard rent
- Any other terms and conditions agreed upon by the parties
The MUARCA also prohibits landlords from charging tenants more than the standard rent. If a landlord does charge more than the standard rent, the tenant can file a complaint with the Rent Control Authority.
Eviction
The MUARCA sets out a number of grounds on which a landlord can evict a tenant. These grounds include:
- Non-payment of rent
- Breach of the terms of the rent agreement
- Subletting the property without the landlord’s consent
- Using the property for illegal purposes
If a landlord wants to evict a tenant, they must file a petition with the Rent Control Authority. The Authority will then hold a hearing and decide whether or not to evict the tenant.
The MUARCA also provides some protection for tenants against eviction. For example, a tenant cannot be evicted if they are pregnant or have a child under the age of 5.
Stamp Duty and Registration in Mizoram
The rent agreement registration is not mandatory for 11 months of agreement. However, if someone wants to register the agreement, here are the stamp and registration charges for rent agreement in Mizoram:
- For rent agreements of less than 11 months:
- Stamp duty: 1% of the annual rent
- Registration fee: Rs. 100
- For rent agreements of more than 11 months:
- Stamp duty: 2% of the annual rent
- Registration fee: Rs. 200
