The FSSAI (Food Safety and Standards Authority of India) has been established under Food Safety and Standards Act, 2006 which incorporates various acts & orders that have hitherto addressed food-related issues in various Ministries and Departments.

FSSAI has been formed for laying down science-based standards for articles of food and to regulate their manufacture, storage, distribution, sale, and import to assure the availability of safe and wholesome food for human consumption.

Amongst the Government agencies, the Food Safety and Standards Authority of India (FSSAI) is the regulatory body responsible for food safety and quality issues across the country. 

Also, FSSAI proposed to support research projects and related innovative R&D proposals about food safety and quality control by extending financial assistance to various institutions and recognized R&D laboratories.

What is FSSAI Registration?

FSSAI Registration is a license granted by the Food Safety and Standards Authority of India that allows the entity to carry on activities related to various stages of manufacturing, processing, packaging, storage, transportation, distribution of food, import and include food services, catering services, sale of food or food ingredients. Any person or entity involved in these services must obtain FSSAI Registration or License.

FSSAI Registration is different from the FSSAI License concerning the size and nature of the business. FSSAI License can be mainly divided into categories, i.e., state-level license and central license.

State-level license is required for Hotels, Restaurants, Millers with the production of less than 1MT per day and other small or medium-scale manufacturers.

Food importers or caters catering to Railways, Air, Defense establishments, and large-scale food manufacturers come under the purview of central license.

FSSAI License number is a 14-digit number issued to register Food Business Operators (FBOs) and it comprises of five sections, each of them providing different information about the food business operator.

  • The first digit provides the details of the status of registration of the business.
  • The second and third digits give information about the state code of the respective business.
  • Digits four and five shows the year of manufacture of the food product.
  • Digits 6,7, and 8 give details about the quantity of enrolling masters.
  • Digits 9, 10, 11, 12, 13, and 14 provide the Makers License Number.

Why FSSAI Registration is Required?

FSSAI Registration is required because of the following reasons:

  1. No person or entity is permitted to commence carry on any food business except under a license/registration as per Section 31 of the Food Safety and Standard Act, 2006.
  2. Under Section 31(2) of the Food Safety and Standard Act, 2006 every Petty Food Business Operator shall register themselves before the commencement of any food business.
  3. Without obtaining an FSSAI license/registration, it is unlawful, illegal and unauthorized and infringes the provision of the Food Safety & Standards Act, 2006.
  4. Every food business operator involved in the manufacture, processing, storage and distribution, and sale of food products must mandatorily obtain FSSAI Registration or License.
  5. As per Section 63 of Food Safety & Standards Act, 2006, if any person or Food Business Operator (except subsection 2 of Section 31) commences or carry on any food business in the absence of a license shall be punishable with imprisonment for a term which may extend to six months and also with a fine which may extend to five lakh rupees.

Who requires FSSAI Registration?

Following Food Business Operators (FBOs) mandatorily require to obtain an FSSAI License or Registration:

  • Petty retailers are involved in retail shops such as Confectionary Shops, Bakeries, Snacks shops, etc.
  • Stalls whether temporary or fixed involved in the preparation, distribution, storage, and sale of food products such as tea stalls, Chat stalls, snacks stalls, Samosa stalls, Golgappa stalls, Fast food stalls, fruit/vegetable vendors, juice shops, ice-cream shops, coconut water shops, etc.
  • Hawkers who sell packaged or freshly prepared food either by foot or movable carts from one location to another mainly in Railway stations, Bus stands, etc.
  • Dairy units include milk vendors, milk chilling units, petty milkmen, milk booths, etc.
  • Slaughtering houses such as a mutton shop, meat shop, eggs shop, lamb meat, fish market, seafood shop, etc.
  • Vegetable Oil processing units such as Desi ghee, mustard oil, etc.
  • Meat processing and fish processing units.
  • Proprietary food or novel food that has been obtained by innovative technology such as Plant meat.
  • All Food Processing/ Manufacturing units that include repacking of food.
  • Cold or refrigerated storage facility.
  • Hotels, Restaurants, Lounges, Clubs, and Bars.
  • Canteens and Cafeterias including mid-day meal canteens or mess.
  • Food vending agencies and Caterers.
  • Dhabas, Dharmshalas, Pg providing food, Banquet Halls with food catering arrangements, Home-based canteens, Tiffin services, Food stalls in fair, fest or religious institutions.
  • Wholesaler, supplier, distributor, and marketer of food products.
  • Transporter of food products carrying several specialized vehicles such as insulated refrigerated van, milk tankers, food wagons, food trucks, etc.
  • Importer and Exporter of any food items or ingredients.
  • E-Commerce food suppliers include cloud kitchens, food delivery apps, fast-food joints, etc.

What are the types of FSSAI Registration?

Registration of FSSAI is based on various factors such as business types, turnovers, installed capacity, and capacity of production. There are three types of FSSAI Registration. These are:

FSSAI Basic Registration

FBOs having a turnover of less than Rs. 12 lakhs per annum must obtain the FSSAI Basic Registration or license. The license is mainly required for Petty Food Business Operators. For this, the applicant has to fill the Form A.

FSSAI State License

FBOs that have a turnover of more than Rs. 12 lakhs per annum and less than Rs. 20 crores per annum must obtain the FSSAI State Registration or license. The license is mainly required for Medium Food Business Operators. For this, the applicant has to fill the Form B.

FSSAI Central License

FBOs that have a turnover of more than Rs. 20 crores per annum must obtain the FSSAI Central Registration or license. The license is mainly required for Large Food Business Operators. For this, the applicant has to fill the Form-B.

Procedure for obtaining FSSAI Registration Certificate/License Online (FSSAI)

Following are the steps to obtain an FSSAI Registration Certificate/License Online:

  1. FSSAI Registration form can be obtained online by filling and submitting the FSSAI Registration form i.e. Form A to obtain Basic FSSAI Registration and Form B to obtain State and Central FSSAI Registration. The form is available on the FoSCoS Portal. Also, the FBOs can apply offline by submitting Form A or Form B to the Food and Safety Department.
  2. This FSSAI Registration form must be accompanied by the relevant documents. The requisite documents must either be uploaded on the FoSCoS Portal at the time of filling the application form or submitted to the Food and Safety Department along with the application form physically. The exhaustive list of the documents can be viewed from FSSAI Online Website.
  3. While filling an application form, the FBOs have to submit a registration fee depending upon the type of Registration obtained.
  4. The FSSAI Registration form can either be accepted or rejected by the Department and the intimation of same with reason can be obtained within 7 days from the date of receipt of an application either physically through post or online through the FoSCoS Portal. If the application is rejected then the applicant is intimated in writing.
  5. The Department will scrutinize the documents and may inspect the food premises or outlet, before granting the FSSAI Registration Certificate or License, if necessary. Such notice for inspection can be ordered within 7 days and must be done within 30 days from the date of receipt of an application.
  6. After the scrutinization and inspection, if the Department is satisfied that the FBOs are eligible and meet all the required criteria, then they will grant an FSSAI Registration Certificate or License with the Registration number and photo of the applicant along with his Email ID. This FSSAI Registration Certificate can also be downloaded by logging into the FoSCoS Portal.
  7. This FSSAI Registration Certificate must be prominently displayed by the FBOs at the place of business during business hours.

Procedure for Central License Application and State License Application (FSSAI)

  • After checking the eligibility criteria, if you fall into the category for Central License, then you will be directed to the Central Licensing page where you have to fill the application form i.e. Form B, and if you fall into the category for State License, then you will be directed to the State Licensing page where you have to fill the application form i.e. Form B Also every data provided to the department must be correct and appropriate.
  • Make sure you must write down the generic names of your food products like a burger, coconut oil, juice, and not brand names.
  • The name of food products must be according to the list approved by FSS Act 2006.
  • If you want to add a new food product then click on ‘Select Food Category‘ in the screen of the Food Processing Unit and from the drop-down menu select the food category. Fill in all food items one by one and the information must be correct as the same will appear on your License.
  • After adding the food item, upload your electronic signature and download the form.
  • At the end of the process, you have to choose the appropriate period you want to apply for the license.

What is the Eligibility for FSSAI Registration?

The basic FSSAI registration is required for all the FBOs involved in small-scale food businesses which includes:

  • Any FBO which has an annual turnover of not more than Rs. 12 Lakhs.
  • Petty retailer dealing in any food products.
  • Temporary stallholder or hawker dealing with any food item.
  • Any person who manufactures or produces and sells any food product by himself.
  • Distributor of food in any religious or social gathering except a caterer.
  • Small-scale or cottage industries dealing in the food business and having the following capacity:

What is the Eligibility for an FSSAI license?

Except for the small-scale FBOs, the FSSAI License has to be obtained for other FBOs which is classified into two categories i.e. State FSSAI License and Central FSSAI License based on the size and capacity of the business.

Procedure for checking the Eligibility for FSSAI Registration Certificate, State or Central License

  1. For obtaining either the State License, Central License, or Registration Certificate, you must have to check the eligibility option first.
  2. For this, you have to provide the serial number, name, and all other information which have been asked by the Food and Safety Department.
  3. You can also operate in more than one premise or unit and work in multiple districts and states.
  4. Then the final step is to check your FSSAI Registration Certificate or License eligibility.

What are FSSAI Registration Fees?

While submitting the FSSAI registration form, the applicant/FBOs needs to pay the fees which are as follows:

How can you check your FSSAI Registration Status?

You are informed by SMS/Email alert at many stages of an application processing by FSSAI. The FSSAI Registration status can be checked by entering the application reference number issued after applying to FSSAI on the ‘Track Application Status’ tab on the FoSCoS Website.

Also, the different stages of the FSSAI Registration status can be viewed by tracking the application status. If the FSSAI Registration status is displayed as ‘Application Reverted‘, it means that the authorities have reverted the application for necessary modification or clarification. After this, you have to submit the response within 30 days from the reverted date to avoid the risk of application rejection. 

When the FSSAI Registration Application is accepted, it will be displayed as ‘Registration Certificate Issued’ and you can download the same by logging into the FoSCoS Website.
